California’s Medical Marijuana "DESIGNATION OF PRIMARY CAREGIVER"
California Health & Safety Code Section 11362.5(e)
A person can be the “Primary Caregiver” if he or she consistently assumes, on your behalf responsibility for your housing, health or safety. In accordance with California Health & Safety Code Section 11362.5(e) which reads as follows:
- (e) For the purposes of this section, “Primary Caregiver” means “the individual designated by the person exempted under this section who has consistently assumed responsibility for the housing, health or safety of that person.”
The Patient agrees that he or she will consistently rely on the designated “Primary Caregiver” to indicate that a relationship based simply on providing the patient with medical marijuana will not suffice. The Patient admits that he or she is unable to grow his or her own marijuana as a condition of having a “Primary Caregiver".“ Therefore, it is likely that a “Primary Caregiver” will be expected to grow the patient’s marijuana at or near the patient’s locale, as a part of the caregiver’s assumed responsibility for the patient’s housing, health or safety needs. “Primary Caregivers” are at risk if they bring marijuana to a patient from outside the home, unless they can, show “that the quantity transported and the method, timing and distance of the transportation are reasonably related to the patient’s current medical needs.” This designation is only to remain in effect for as long as the Patient has a valid updated recommendation or approval to use medical cannabis in treating his or her illness. Lastly, the “Primary Caregiver” understands that caregiver status does not give you permission to use medical marijuana.

Asset Forfeiture and Dog Sniffs.
The following cases present an overview of current case law established in various Federal Courts.
- United states v. One Lot of U.S. Currency
($36,674), 103 F.3d 1048 (1st Cir. 1997). Dog sniff along with defendant’s connection to known criminals, a quantity of cash, itinerary of air travel, and evasive questions all add up to probable cause.
- United States v.Carr
, 25 F.3d 1194 (3d Cir 1994); Dog sniff supports finding that laundered cash is drug proceeds.
- United States v. $39,873.00
, 80 F.3d 317 (8th Cir.1996); Dog Sniff, packaging of currency, and proximity to drug paraphernalia, provided sufficient probable cause for seizure of currency during highway stop.
- United States v. $9,135.00 in U.S. Currency
, 1998 WL 329270 (E.D. La. June 18, 1998 )….Courier Profile; nervous behavior and absence of luggage; bundling of currency in pockets and shoes; implausible story, dog sniff and lack of sufficient legitimate income together established probable cause.
- United States v. $94,010.00 in U.S. Currency
, 1998 WL 567837 (W.D.N.Y. Aug 21, 1998)…. A false story about destination, concealment of cash in false compartment and an alert by drug dog showed the Government had sufficient evidence to satisfy particularity requirement in Rule E(2)(a); Dog Sniff is probative evidence in Second Circuit.
HOWEVER, one should read;
- United States v. $40,000.00 in U.S. Currency
, 999 F. Supp. 234 (D.P.R. 1998)
Dog sniff, drug courier profile, quantity of currency, and evasive answers are not sufficient to establish probable cause where the government fails to establish any connection between claimant and any drug trafficker.
