Things The Cops Look For During Traffic Duty's &
Road Side Stops, 6/5/03
A cop offers advice on not getting stopped by law enforcement.
The
following list of do's and don'ts are intended to make all drivers aware of
what action's they should take to ensure they will get from point A to point B
without getting a ticket and minimizing the risk of a negative encounter with
law enforcement.
1
- Always have a valid drivers license - You can be searched, arrested or
issued a ticket for no operators permit.
2
- Keep all vehicle paperwork in one location, glove box or other easy to reach
location in your
vehicle. The less you move around searching for your paperwork the better,
officers are worried about getting shot or that you are hiding something.

- Keep all contraband (pipes, rolling papers etc.)
away from your vehicle paperwork.

- Wear your seatbelt. For those of you living in the dark ages, the police can
stop and ticket you for no seatbelt.

- Buckle the kids and use car seats for youngsters.

- Do not hang objects from your rear-view mirror. (Buttons, dice, photos,
etc.) Object's hanging from the rear-view mirror are considered obstructions
to vision.

Ensure your vehicle's headlights, turn signals & taillights are in proper
working order. A one-eyed car stands out when driving at night, as does
a vehicle with no taillights.

- Ensure the light over the license plate is working and the license plate is
properly displayed, do not place the license plate in your back window.

- Ensure your exhaust system is in good working order. No loud mufflers.

- Fix Cracked windshields; cracked windshields are considered obstructions to
vision.

- Use turn signals and obey the speed limit, you can go with the flow of
traffic but if it's over the speed limit you can still be ticketed.

- Do not keep roaches or joints in your ashtray. It is better to toss out
small roaches than get caught with them. What's cheaper $2.00 worth of pot or
a marijuana charge?

- New Michigan State law requires you move one lane over when you observe a
police vehicle on a traffic stop, if you cannot
safely move over one lane, slow down and use caution.

- If smoking anything hand-rolled that may look like a joint while driving use
caution; sometimes other drivers notify the police if they observe people
smoking hand-rolled cigarettes.

These
are some of the most frequent reasons for a traffic stop if you follow these
simple guild lines you will greatly reduce your chances of getting stopped and
ticketed.
If
you are stopped be polite, courteous and address the officer as sir / ma'am
and keep your hands where the officer can see them.
The
U.S. Supreme Court has ruled that when a officer stops you for a traffic
violation he / she can ask you to step out if the vehicle and conduct a pat
down search of your person. This does not mean they can search your vehicle.
When
asked to consent to a vehicle search simply say "No" or "I
prefer to hold onto my constitutional guarantees and no".
Never
consent to a vehicle search and don't get into a shouting match with the
officer, if you have a complaint get the officer's name & badge number
then go make your complaint at the officer's station or post; if warranted
seek legal advice.
