Washington State Medical Marijuana
CannaCare Raided By The DEA 1-16-07
For over a year, Steve Sarich, the director of
CannaCare,
and John
Worthington, a former CannaCare member, have been collecting evidence
proving that the State is using taxpayer money to fund joint drug task
forces. These drug task forces have been arresting patients
and, instead of
turning them over to county prosecutor and state courts, they have been
calling in the DEA to deny them their right to an affirmative defense under
the state medical marijuana law.
We apologize for not getting this out sooner, but we lost all of our
computers and we have been spending our time contacting individual
member/patients.
For over a year, Steve Sarich, the director of CannaCare,
and John Worthington, a former CannaCare member, have been collecting evidence proving that the State is using taxpayer money to fund joint drug task forces. These drug task forces have been arresting patients
and, instead of turning them over to county prosecutor and state courts, they have been calling in the DEA to deny them their right to an affirmative defense under the state medical marijuana law.
The biggest culprit has been Detective Roy Alloway (Westnet) operating out of Kitsap County. We have presented evidence of Alloway's activities to the State Attorney General, CTED (a state agency funding the drug task forces), Lt. Rich Wiley (the WSP coordinator who oversees the drug task forces) and members of the State Legislature.
On Friday, Detective Alloway retaliated in what can only be viewed as a political assassination. Alloway and Wesnet simultaneously raided the homes of both Steve Sarich and John Worthington. These two raids, which took place in Snohomish and King County, were based on warrants issued by a judge in Kitsap County and were conducted by a Kitsap based task force. In both raids the Westnet task force failed to notify
King and Snohomish law enforcement or county prosecutors. Instead, Alloway called in agents from the DEA and refused to contact local prosecutors.
At both locations they seized the research and documentary evidence of impropriety and malfeasance by local authorities and task forces. These documents were not listed on the search warrant. They also took some patient records, which were also not listed on the warrant. We are working rapidly to notify these patients of this illegal seizure.
At Mr. Sarich's home they destroyed his vegging plants and virtually destroyed his home. They did not find a single flowering plant and most of the plants destroyed were rooting clones. They also seized less than one ounce of dry marijuana and a relatively small amount of cash that was to be used to pay his power and cable bill. CannaCare is Not a medical dispensary and they found no evidence of sales or distribution. At the home of Mr. Worthington they were even less
successful. This raided netted only six plants being grown for his own personal use and no evidence of sales. No dry marijuana was seized. Both are legal med patients, each with valid authorizations from two separate physicians.
At Sarich's home they found a small number of medicinal cookies and Sarich pointed out they they were medicinal. Two witnesses observed task force members consuming nearly a whole plate of marijuana cookies while spreading dirt around the house.
Neither Sarich or Worthington were arrested at the time of the raid,but the DEA agents promised federal indictments. While the DEA and the federal prosecutors have consistently told the press that they are not going after med patients, and that they are only going after "profiteering dispensaries", this raid on a political and patient support organization that doesn't even operate a dispensary, certainly proves that their public statements to the press, the
Washington State legislature, and the public, cannot be trusted.
This raid came only days after Worthington turned in his study on the state of medical marijuana in Washington State to the State Judiciary Committee. This report was critical of the drug task forces. Was it just a coincidence that he was raided by one of these task forces, and the DEA, only days after the study was submitted to the legislature? The Washington State legislature must stop this state funded terrorism against legal medical marijuana patients and activists. This is certainly not what the voters of Washington had in mind when
they passed I-692.
Since this is an ongoing legal case, we will not be answering
questions regarding specifics of the case. We only hope that
everyone who supports the safe access of patients to their
medication will join us in taking action against this violation
of patients' rights and the funding of state sponsored terrorism.
