California's Medical Marijuana DESIGNATION OF A PRIMARY CAREGIVER

"DESIGNATION
OF PRIMARY CAREGIVER"
California Health & Safety Code Section 11362.5(e)
A person can be the “Primary Caregiver” if he or she
consistently assumes, on your behalf
responsibility for your housing, health or safety. In accordance with
California Health & Safety
Code Section 11362.5(e) which reads as follows:
- (e) For the purposes of this section, “Primary Caregiver” means
“the individual designated by the
person exempted under this section who has consistently assumed
responsibility for the housing,
health or safety of that person.”
The Patient agrees that he or she will consistently rely on the designated
“Primary
Caregiver” to indicate that a relationship based simply on providing the patient with
medical marijuana will not suffice. The Patient admits that he or she is unable to grow
his or her own
marijuana as a condition of having a “Primary Caregiver".“ Therefore,
it is likely that a “Primary
Caregiver” will be expected to grow the patient’s marijuana
at or near the patient’s locale, as a part of the caregiver’s assumed responsibility for
the patient’s housing, health or safety needs. “Primary Caregivers” are at risk if they
bring marijuana to a patient from outside the home, unless they can, show
“that the
quantity transported and the method, timing and distance of the transportation
are
reasonably
related to the patient’s current medical needs.” This designation is only to
remain in effect for as long
as the Patient has a valid updated recommendation or
approval to use medical cannabis in treating his
or her illness. Lastly, the “Primary
Caregiver” understands that caregiver status does not give
you permission to use
medical marijuana.
